1. About AFRA Construction

AFRA Construction is a licensed building contractor operating in New South Wales, Australia. We are fully licensed under NSW Fair Trading and comply with all relevant Australian building codes and regulations.

2. Services

We provide construction services including:

  • New home construction
  • Duplex and multi-unit development
  • Granny flats and secondary dwellings
  • Home extensions and renovations
  • Commercial construction projects

3. Quotations and Estimates

  • All quotations are valid for 30 days unless otherwise specified
  • Quotations are based on information provided and site inspections
  • Final costs may vary based on site conditions, material prices, and scope changes
  • Additional work outside the original scope will be quoted separately

4. Contracts and Agreements

  • All construction work is governed by a written contract
  • Contracts comply with NSW Home Building Act 1989
  • Statutory warranties apply as required under NSW law
  • Home Building Compensation Fund coverage applies where required

5. Payment Terms

  • Payment schedules are outlined in individual contracts
  • Progress payments are linked to completion milestones
  • Final payment is due upon practical completion
  • Late payment fees may apply as specified in contracts

6. Permits and Approvals

  • We assist with obtaining necessary building permits and approvals
  • Council and regulatory approval costs are additional unless specified
  • Work will not commence without required permits
  • Delays due to approval processes are beyond our control

7. Materials and Workmanship

  • We use quality materials from reputable Australian suppliers
  • All work meets or exceeds Australian building standards
  • Material specifications are detailed in contracts
  • Substitutions may be made for equivalent or better materials

8. Timeframes and Delays

  • Project timeframes are estimates based on normal conditions
  • Weather, permit delays, and unforeseen conditions may affect timing
  • We will communicate any delays promptly
  • Extension of time claims will be assessed fairly

9. Variations and Changes

  • All variations must be approved in writing
  • Additional costs for variations will be quoted before proceeding
  • Changes may affect project timeline
  • Some variations may require additional permits

10. Insurance and Liability

  • We maintain comprehensive public liability insurance
  • Workers compensation insurance covers all employees
  • Home Building Compensation Fund coverage where applicable
  • Clients should maintain appropriate property insurance

11. Warranties

  • Statutory warranties apply under NSW Home Building Act
  • Structural work: 6 years
  • Non-structural work: 2 years
  • Defects liability period as specified in contracts

12. Health and Safety

  • All work complies with NSW Work Health and Safety regulations
  • Site safety is our priority
  • Clients and visitors must follow site safety requirements
  • We maintain appropriate safety documentation

13. Dispute Resolution

  • We aim to resolve disputes through direct communication
  • NSW Fair Trading mediation services are available
  • NCAT (NSW Civil and Administrative Tribunal) jurisdiction applies
  • Australian Consumer Law protections apply

14. Limitation of Liability

Our liability is limited to the extent permitted by Australian Consumer Law and NSW building legislation. We are not liable for consequential damages beyond the scope of our contracted services.

15. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in NSW courts or tribunals.
